For the academic year 2022 – 23 the High Court of Karnataka has quashed the circular issued by the Karnataka School Quality Assessment and Accreditation Council (KSQAAC) changing the method of assessment for the students of class 5 and 8
Justice Pradeep Singh Yerur, Karnataka High Court said that the circular issued by the Karnataka School Quality Assessment and Accreditation Council (KSQAAC) regarding conducting Assessment Examination for the students of class 5 and class 8 is not in consonance with section 13 (4) of the RTE Act which states that every rule or notification shall be placed before the state legislature as soon as possible,
However the Justice Pradeep Singh Yerur, said the court order does not stop the Karnataka State Government from implementing the new method of assessment in accordance with the provisions under RTE Act
The petitions filed by the Organization for Unaided Recognized Schools, Registered Unaided Private Schools Management Association and others had challenged the decision of the Karnataka School Quality Assessment and Accreditation Council (KSQAAC) to conduct state level board exams for the students of class 5 and class 8, they claimed the decision is being taken at the time when the exams are near and it will affect the students and parents
