On the first day of the Monsoon Session, the ‘Bills of Lading, 2025’ Bill was successfully passed by the Rajya Sabha, marking a significant legislative milestone in India’s maritime trade sector. Having already received approval from the Lok Sabha, the bill now awaits Presidential assent to become law.
The bill is set to replace the archaic Indian Bills of Lading Act, 1856, which has governed shipping documentation for over 169 years. Recognizing the need to align with contemporary global trade practices and digital advancements in maritime commerce, the new legislation introduces a modern, streamlined, and internationally compatible legal framework for shipping documentation.
The Bills of Lading, 2025 Bill seeks to simplify legal language and remove ambiguities that often hinder interpretation and enforcement. It clearly defines the rights, responsibilities, and obligations of all stakeholders involved in maritime shipping—including carriers, shippers, and consignees—thereby reducing the potential for legal disputes and promoting quicker resolution of commercial conflicts.
A key feature of the bill is its strong support for the Government of India’s Ease of Doing Business (EODB) initiative. By minimizing litigation risks, ensuring clarity in transactions, and enabling digital and efficient documentation processes, the bill is expected to enhance India’s attractiveness as a reliable and competitive player in global trade and shipping.
The legislation also includes an enabling clause empowering the Central Government to make necessary rules and regulations for its effective implementation, allowing flexibility to adapt to evolving industry practices and technological developments. Additionally, the bill provides for a repeal and saving clause, ensuring that actions and decisions taken under the old 1856 Act remain legally valid, thereby safeguarding legal continuity and preventing disruption in ongoing trade processes.
