Anju Rathi Rana Appointed Ex-Officio Member of IBBI

In a significant development for India’s regulatory landscape, Anju Rathi Rana, the current Law Secretary and the first woman to hold the position of Secretary, Legal Affairs, has been appointed as an ex-officio member of the Insolvency and Bankruptcy Board of India (IBBI). The appointment, made by the central government under Section 189 of the Insolvency and Bankruptcy Code (IBC), 2016, strengthens the representation of the Ministry of Law & Justice on the IBBI board.

Rana, a senior officer of the Indian Legal Service, brings over two decades of legal acumen to the table. She served as a public prosecutor for 18 years, gaining extensive courtroom and prosecutorial experience, before transitioning to the Ministry of Law and Justice in 2017 as a Joint Secretary. Her elevation to Law Secretary in March 2025 marked a historic moment, as she became the first woman to hold the top legal administrative post in the ministry.

Her induction into the IBBI is seen as a strategic move to bolster the board’s legal foundation and ensure well-rounded decision-making in matters concerning insolvency and bankruptcy. The IBBI, which plays a critical role in overseeing India’s insolvency resolution framework, already includes representation from key bodies such as the Ministry of Finance, Ministry of Corporate Affairs, and the Reserve Bank of India, along with other financial and legal experts.

Rana’s appointment not only adds diversity but also underscores the growing importance of legal insight in shaping insolvency policies and protecting stakeholder interests. Her deep understanding of legal procedures, regulatory frameworks, and public law is expected to contribute significantly to the streamlining of insolvency resolution processes, especially in cases involving complex legal challenges.

Government officials hailed the appointment as a step forward in aligning India’s insolvency regime with international best practices, with one senior bureaucrat noting, “Ms. Rana’s presence on the IBBI Board brings immense value given her prosecutorial background and leadership in legal reforms.”

As the IBBI continues to evolve in its role of fostering a time-bound and efficient insolvency framework, Anju Rathi Rana’s inclusion is poised to strengthen the legal oversight and credibility of the board, ensuring a balanced and robust regulatory environment for India’s economic ecosystem.
